Trademark FAQs - related questions & answers

Question: Does the U.S. Patent & Trademark Office have free searchable trademark databases?

Answer:
Yes, the Trademark Electronic Search System (TESS) is available online to perform trademark and servicemark searches.

Question: Do you need to be a corporation to obtain a trademark?

Answer:
No. The trademark applicant is the one who owns the mark. Normally the person who produces the goods or who renders the services related to the mark controls the use of the mark.

Question: Do I have to be a U.S. Citizen to obtain a federal registration?

Answer:
No. However, an applicant's citizenship must be stated in the record. If an applicant is not a citizen of any country, then a statement to that effect is adequate.
